We are RICS registered Expert Witnesses. Expert evidence can be required in disputes across land, property and construction. RICS expert witnesses are able to assist the court on the matters within their expertise across areas including building surveying, commercial property, compulsory purchase, dilapidations, planning, development, retail and valuation.
We specialise in housing disrepair working with several Solicitors across the northwest.
If your property is in a state of disrepair, it can be difficult to get your landlord to take action. This can make it difficult to live in your home and can also affect your health. As Expert Witnesses we are completely independent with a focus on establishing the actual disrepair under the legislation namely Section 11, 9A and 10 of the Landlord and Tenant Act 1985. Landlords are responsible for meeting specified basic conditions and certain repairing obligations, however, there are conditions to this, and Section 11 will not apply where the tenant is at fault. Establishing causality is a pivotal consideration when assessing disrepair.
NTR produce Expert Witness reports for both landlords and tenants. We carry out a thorough inspection of the property items of disrepair listed on the Letter of Claim. We provide a comprehensive Expert Witness report for the Tribunal with commentary on whether the requirements of Section 11 are met including causality and the reason behind the disrepair. The report is issued with a comprehensive Scott Schedule for the other surveyor to comment on.
